1. Acceptance of Terms

By downloading, installing, or using the Mystic Tarot application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Continued use of the App following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to use the App in order to comply with the General Data Protection Regulation (GDPR) applicable in the European Union. In regions where a lower minimum age applies, users must be at least 13 years of age. If you are under 18, you confirm that you have obtained parental or guardian consent before using the App. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Entertainment Purposes Only

All tarot readings, interpretations, horoscopes, compatibility results, and related content provided by Mystic Tarot are strictly for entertainment purposes only. The App does not provide professional, medical, psychological, legal, financial, or any other form of licensed advice. Readings are generated using artificial intelligence (OpenAI) and should not be treated as factual, predictive, or authoritative.

4. No Guarantees on Accuracy

Mystic Tarot makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of any readings or content. AI-generated readings are based on randomized card selections and language models and do not reflect real psychic, spiritual, or supernatural insight. You acknowledge that results may vary and should not be relied upon for making important life decisions.

5. User Responsibility

You are solely responsible for any actions, decisions, or consequences that arise from your use of the App or reliance on its content. Mystic Tarot, its developers, affiliates, and partners shall not be held liable for any damages, losses, or harm resulting from your interpretation of or reliance on readings provided by the App.

6. Free Tier and Advertising

The App offers a free tier that includes the following daily complimentary features:

• One (1) daily horoscope reading based on your zodiac sign
• One (1) complimentary tarot reading per day
• Up to three (3) additional readings per day accessible by watching rewarded advertisements

Ads are served through Google AdMob, and by using the free tier you consent to the display of personalized and non-personalized advertisements based on your preferences and usage data.

7. Premium Subscription

Mystic Tarot offers an optional premium subscription that provides the following benefits:

• Unlimited tarot readings with no daily limits
• Ad-free experience
• Unlimited streak freezes
• Access to all 77 exclusive card designs

Subscriptions are managed and processed through RevenueCat and the Google Play Store. Pricing and billing cycles are presented at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your Google Play Store account settings. Refunds are subject to the policies of the Google Play Store. We reserve the right to modify subscription pricing with reasonable advance notice to users.

8. AI-Generated Content and Automated Decision Making

Readings and interpretive content within the App are generated using artificial intelligence technology provided by OpenAI. When you submit a question or request a reading, your name, zodiac sign, selected question, and reading category are sent to OpenAI's servers for processing. This constitutes automated decision making. While we strive to deliver thoughtful and meaningful readings, AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results. Mystic Tarot is not responsible for the output of AI models and reserves the right to modify or update the AI systems used at any time.

9. Data Collection and Privacy

To provide our services, Mystic Tarot collects certain personal information including your email address, display name, birth month and day (used to determine your zodiac sign), and reading history. This data is used to personalize your experience, generate relevant readings, and improve the App. For full details on how we collect, use, store, and protect your data, please refer to our Privacy Policy.

10. Intellectual Property

All content, designs, graphics, original card artwork, text, code, branding, and visual assets within the App are the exclusive property of Mystic Tarot and its licensors and are protected under international copyright law. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only. You may not copy, modify, distribute, reproduce, reverse-engineer, decompile, or create derivative works from any part of the App or its assets without prior written consent from Mystic Tarot.

11. Prohibited Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the App
• Exploit the App to harass, abuse, or harm others
• Circumvent or manipulate any security features, usage limits, or payment mechanisms
• Use automated systems (bots, scrapers) to access the App
• Redistribute, resell, or commercially exploit App content without authorization
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

12. User Generated Content

When you type questions or intentions into the App, you retain ownership of that content. However, by submitting content you grant Mystic Tarot a non-exclusive, royalty-free license to process and transmit that content solely for the purpose of generating your reading via our AI systems. Your questions and inputs are transmitted to OpenAI for processing as described in our Privacy Policy.

13. Third-Party Services

The App integrates with third-party services including OpenAI (reading generation), Google AdMob (advertising), RevenueCat (payment processing), Supabase (database and authentication), and Expo/EAS (push notifications). Your use of these services is subject to their respective terms and privacy policies. Mystic Tarot is not responsible for the practices, availability, or content of third-party services.

14. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

15. Force Majeure

Mystic Tarot shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, server outages, third-party service failures, internet disruptions, or other circumstances outside our reasonable control.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Mystic Tarot and its developers, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the App, even if advised of the possibility of such damages.

17. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or your use of the App, we encourage you to first contact us directly at contact@mystictarotapp.com to seek an informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the competent courts of the Republic of Moldova in accordance with Section 18.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Moldova, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of the Republic of Moldova.

19. Modifications to Terms

Mystic Tarot reserves the right to modify, update, or replace these Terms at any time, at its sole discretion. Material changes will be communicated to users via in-app notification or email with reasonable advance notice. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

20. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
